Social exclusion of older people - legal responses

As European societies age, the demographic structure of society is also changing. On the one hand, fewer and fewer children are born, and on the other hand, everyday living conditions and medical care are becoming more sophisticated, leading to a gradual increase in life expectancy. Consequently, the proportion of elderly people in the total population is steadily increasing, with their issues evolving into a widespread, multifaceted problem. The elderly face many challenges, such as social exclusion, particularly after retirement. They are also more vulnerable to various forms of violence and crime, and poverty, which can lead to a deterioration in their quality of life and further pathologisation.
Digital exclusion is a serious issue given the rapid development of technology, particularly in communication and information-sharing systems, which are shifting many activities into the virtual realm. In this context, it is crucial to emphasise the role of the family and to promote the development of family relationships, values, attitudes and behaviours that aim to motivate younger family members to support and care for their elderly relatives. The state should support families in these tasks. Furthermore, if families are unable to provide for the elderly, the state must take responsibility based on principles such as subsidiarity, social solidarity, respect for human dignity, social equality, and non-discrimination. The difficulties faced by the elderly must be alleviated through appropriate regulation and financial support. Examples include encouraging longer working lives, especially in those occupations where this is possible, and promoting social activity and preventive healthcare. This requires action at many levels, from combatting discrimination to improving access to services and promoting the active participation of elderly people in society for as long as possible.
