Legal Aspects of Artificial Intelligence

“Legal Aspects of Artificial Intelligence” is a publication edited by Prof. Agnieszka Gryszczyńska available through the Publishing House of the Institute of Justice.

This work is the product of a distinguished collaboration between eminent researchers from Poland and Hungary, conducted under the auspices of the Polish-Hungarian Research Platform 2022. The researchers were divided into four teams. One of the topics studied was the Legal Aspects of Artificial Intelligence. This book represents the efforts of one of these research teams, under the expert editorship of team leader Prof. Agnieszka Gryszczyńska.

The book explores various legal aspects of AI, beginning with an analysis of the right to a fair trial from the Council of Europe’s perspective and a critique of its AI guidelines. It then examines the concept of AI as a legal or technological person and the potential for AI to serve as a judge. Another section addresses the intersection of criminal law and AI, covering definitions, classifications, and the implications of AI for criminal liability and penalties. Further chapters assess the impact of proposed EU regulations on AI, particularly in the context of Polish law enforcement and judicial systems, and discuss the current state and progress of AI regulation in Poland and the EU. The final section delves into the use of AI in law enforcement and justice, highlighting applications in crime detection, criminology prediction, and automated decision-making, and considers how to create laws for AI, reflecting the EU’s approach. The publication underscores the importance of international cooperation and ongoing research to address AI’s legal challenges, promoting the development of best practices and ethical guidelines for AI use in legal contexts.
