The rule of law is at the heart of the state's political system, governing the actions of public authorities and individuals. The rule of law underpins political systems, legislation, interpretation of law and public decision-making, and protects individual freedoms against tyranny, arbitrariness and the monopolisation of power. Recent political, social and economic changes in Poland have changed the meaning of this legal order.
The new governing coalition has initiated significant changes to the political system and civil rights, often going beyond the limits of legal powers, and has legitimised these measures by invoking the rule of law. This project examines the modern understanding of the rule of law, the factors influencing its development and its application by the Polish authorities. The research team will investigate whether these measures redefine or undermine Poland's constitutional rule of law, and will analyse legislative, governmental and judicial actions through legal analysis, case law review, literature and media reports, allowing an understanding of the true nature of these changes.
