Social exclusion of older people - legal responses

The ageing of European societies is a fact, with a consequent change in their demographic structure. On the one hand, fewer and fewer children are born, while on the other hand, everyday living conditions and medical care are at an increasingly high level, leading to a gradual increase in life expectancy. As a result, the proportion of older people in the total population is steadily increasing and their problems are becoming a common problem of a multidimensional nature. Older people face many challenges - social exclusion, especially after retirement, violence of all kinds, increased vulnerability to crime, the risk of poverty, which leads to a reduced quality of life and becomes a source of further pathologisation.
Digital exclusion is a very serious challenge in the context of the rapid development of technological progress, especially in communication and information-sharing systems, which are transferring many traditional activities to virtual reality. In this context, it is extremely important to emphasise the role of the family and to promote family relationships, a system of values, attitudes and behaviours aimed at motivating younger family members to support and care for their elderly relatives. The State should support families in fulfilling these functions and, when families fail to do so, the State should assume responsibility for the fate of the elderly as a consequence, inter alia, of the principles of subsidiarity, social solidarity, respect and protection of human dignity, social equality and non-discrimination. The effects of ageing are to be mitigated through appropriate regulation and financial support. This is also supported by encouraging longer working lives, especially in occupations that allow it, and by promoting social activity and preventive health care. It is therefore essential to take action at a number of levels - from combating discrimination, to improving access to services of all kinds, to promoting the active participation of older people in society for as long as possible.
